Juniper Avenue Web Hosting provides web hosting services, website design packages, email services and domain registration. Use of any of Juniper Avenue’s services constitutes acceptance of and agreement with Juniper Avenue’s Acceptable Use Policy and Terms of Use as set forth below:
System and Network Security: Users are prohibited from violating or attempting to violate the security of any part of the Juniper Avenue system or network. Violations of may result in civil or criminal liability. Juniper Avenue will investigate any such violations or attempted violations, which may involve, and cooperate with, law enforcement authorities in prosecuting Users who are involved in such violations. These violations include, without limitation: accessing data not intended for such User or logging into a server or account that such User is not authorized to access; attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization; attempting to interfere with service to any user, host or network, including, without limitation, via means of overloading, "flooding", "mail bombing" or "crashing"; forging any TCP/IP packet header or any part of the header information in any e-mail forum posting; taking any action in order to obtain services to which such User is not entitled. A valid credit card is required for all Juniper Avenue services for verification purposes. Accounts created using an invalid credit card will immediately be deleted.
Illegal Use: Juniper Avenue’s servers are for lawful use only.
Transmission, storage, or distribution of any information, data, or material in
violation of any applicable law or regulation, or that may directly facilitate the
violation of any federal, state, or local law or regulation is prohibited. This
includes, but is not limited to: copyrighted material; trademarks; trade secrets
or other intellectual property rights used without proper authorization; material
that is obscene, defamatory, constitutes an illegal threat, or violates export control
laws. Use of Juniper Avenue’s services or equipment for creating or sending Internet
viruses, worms or Trojan horses, or for pinging, flooding or mail bombing, or engaging
in denial of service attacks is prohibited. It is also prohibited for any customer
to engage in any activity that is intended to disrupt or interfere with, or that
results in the disruption of or interference with, or the ability of others to effectively
use Juniper Avenue’s services and equipment (or any connected network, system, service
or equipment) or conduct their business over the Internet. Any account engaged in
any of these activities will be terminated without notice.
Adult Material: Pornography and sex-related material or merchandising
is prohibited. This is also true for sites that promote illegal activity of any
type or content that may be damaging to Juniper Avenue's servers or other servers
on the Internet. Links to such materials are also prohibited. The use of Juniper
Avenue’s services to store, post, display, transmit, advertise or otherwise make
available child pornography is strictly prohibited. Juniper Avenue is required by
law, and will, notify law enforcement agencies when it becomes aware of the presence
of child pornography on, or being transmitted through, its services.
Spamming: Sending unsolicited bulk and/or commercial messages over the Internet is prohibited, regardless of whether or not it overloads a server or disrupts service to Juniper Avenue’s customers. This includes, but is not limited to, maintaining an open SMTP policy, engaging in spamming using the service of another ISP or IPP and referencing in the spam a web site hosted on Juniper Avenue’s server, and selling or distributing software that facilitates spamming. Juniper Avenue reserves the right to determine, in its sole and absolute discretion, what constitutes a violation of this policy. Violators will be immediately suspended without prior notice.
Server Resources: Any Web Site that uses a high amount of Server resources (such as, but not limited to CPU Time, Memory Usage, and Network Resources) will be given an option of either upgrading their service level or reducing the resources used to an acceptable level.
CGI Scripts: Each account comes with a cgi-bin. Users may use CGI scripts; however, Juniper Avenue reserves the right to disable any CGI script that affects normal server operation without prior warning. Any scripts that pose a potential security risk or are deemed to be adversely affecting server performance, network integrity, or other Users will be shut down or removed without prior notice. Juniper Avenue does not permit CGI script sharing with domains not hosted by Juniper Avenue or any scripts that may be abused for Unsolicited Commercial Email purposes.
Payment: User agrees at time of signup with Juniper Avenue to pay the posted fees on a timely basis. Unpaid invoices will result in termination of services. Recurring fees will be charged to the Credit Card User provides at signup. Juniper Avenue will notify User by email in the event of a lapsed or expired credit card or other payment problem and will make every effort not to disrupt service to User until issue is resolved.
Indemnification: User agrees that it will protect, indemnify, save and hold Juniper Avenue harmless from any and all stipulations, liabilities, losses, expenses and claims, as well as reasonable attorney's fees assessed against Juniper Avenue, its agents, customers, officers, employees and administration that may arise or result from any service provided or performed or agreed to be performed or any product sold by it's customers, agents, employees or assigns. Customer agrees to defend, indemnify and hold Juniper Avenue harmless against liabilities arising out of; (1) any injury to person or property caused by any products sold or distributed in association with Juniper Avenue’s Services; (2) any material furnished by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright violation and any defective products sold to a Customer from Juniper Avenue’s Services.
User Responsibility: Users are required to use Juniper Avenue's services responsibly. Juniper Avenue reserves the right to suspend and/or cancel service with any customer who uses the Juniper Avenue network in such a way that adversely affects other customers. While Juniper Avenue may monitor its service electronically to determine that its facilities are operating satisfactorily, as a general practice, Juniper Avenue does not monitor its Users communications or activities to determine whether they are in compliance with the TOU. However, when Juniper Avenue becomes aware of any violation of the TOU or other user agreements, Juniper Avenue reserves the right to take any action to stop or correct such violation, including, but not limited to, denying access to Juniper Avenue's services and equipment. Further, Juniper Avenue makes every effort to ensure the security and safety of all legal and permitted material User places on its servers; however, User is ultimately solely responsible for backing up and preserving all data, web pages, databases, images, content, etc., that User has hosted on Juniper Avenue's servers.
Disclaimer: Juniper Avenue's services are provided on an as is, as available basis without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose or non-infringement. Juniper Avenue expressly disclaims any representation or warranty that the servicse will be error-free, secure or uninterrupted. No oral advice or written information given by Juniper Avenue, its employees, licensors or the like, will create a warranty; nor may you rely on any such information or advice. Juniper Avenue and its partners and suppliers will not be liable for any cost or damage arising either directly or indirectly from any transaction or use of the service.

This Terms of Use Agreement is in effect immediately upon signing up for any service with Juniper Avenue; subsequent use of any of Juniper Avenue's services constitutes agreement to these Terms of Use. Juniper Avenue reserves the right to revise, amend or modify Terms of Use at any time without notice.
